My Property Kit (ABN 53 692 493 342) is a licensed NSW conveyancing practice based in Leichhardt NSW 2040. This policy explains how we collect, use, store and disclose your personal information. We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

What we collect

We collect the information we need to quote for and carry out your matter. This can include your name, phone number, email and postal address; details of the property and transaction; contracts and other documents you send us; identity documents and information needed to verify your identity; and financial details needed for settlement, such as your lender and the accounts settlement funds are paid to or from.

We may also collect information about other people involved in your matter, such as co-purchasers, the other party, agents and lenders.

How we collect it

Most information comes directly from you, through our website forms, by phone, by email or when you buy a contract review. We may also collect information from real estate agents, the other party's conveyancer or solicitor, your lender or broker, NSW Land Registry Services, Revenue NSW, councils and other search providers, PEXA, and identity verification providers.

Why we use it

We use your information to respond to enquiries and send quotes; review contracts and provide conveyancing services; verify your identity and meet our legal and regulatory obligations; take payment; keep you updated on your matter; and improve our website and services. We may send you information about our services, and you can opt out at any time.

Who we share it with

We only share your information where it is needed for your matter or required by law. This can include the other party's conveyancer or solicitor, real estate agents, your lender or broker, PEXA, NSW Land Registry Services, Revenue NSW, councils and search providers, identity verification providers, our IT, email, website and payment providers, our professional advisers and insurers, and regulators or government agencies where the law requires it.

We do not sell your personal information.

Storage overseas

Some of our service providers, including our website and email platforms, may store information on servers outside Australia, including in the United States. We take reasonable steps to make sure these providers protect your information.

Our website

Our website is hosted by Squarespace. When you use it, standard information such as your IP address, browser type and pages visited may be collected through cookies and analytics tools. Information you enter into our forms is sent to us by email and stored by our website and email providers. You can set your browser to refuse cookies, although some features may not work as intended.

Security and how long we keep it

We take reasonable steps to protect your information from misuse, loss and unauthorised access. We keep client files for as long as we need them for your matter and for as long as the law requires us to keep records, then securely destroy or de-identify them.

Accessing or correcting your information

You can ask for access to the personal information we hold about you, or ask us to correct it, by contacting us. We may need to verify your identity first, and in limited cases the law allows us to refuse access. If so, we will tell you why.

Complaints

If you have a concern about how we have handled your personal information, please contact us first and we will respond within 30 days. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
